These Terms of Service govern use of the Falling West website, Falling West Social Manager, and related services.
1. Falling West Website
Falling West provides apparel, product information, and related online services through FallingWest.com. By using this website, you agree to use it only for lawful purposes and in accordance with these Terms.
Product descriptions, pricing, availability, shipping information, and other website content may be updated or corrected at any time. We reserve the right to refuse or cancel orders where reasonably necessary, including in cases of pricing errors, suspected fraud, inventory issues, or misuse of the website.
2. Intellectual Property
Unless otherwise stated, Falling West owns or is authorized to use the website content, branding, graphics, product artwork, text, videos, software, and other materials made available through Falling West.
You may not copy, reproduce, distribute, sell, modify, or commercially exploit Falling West content without permission except where permitted by law.
3. Falling West Social Manager
Falling West Social Manager is a private internal software tool used to prepare, schedule, and publish promotional content for Falling West social-media accounts.
The application is not offered as a public service and does not provide third parties with access to Falling West social accounts.
4. YouTube API Services
Falling West Social Manager uses YouTube API Services to connect to an authorized YouTube channel and upload videos selected by the authorized user.
By using YouTube features within Falling West Social Manager, you also agree to be bound by the YouTube Terms of Service.
Falling West Social Manager may request permission to view basic YouTube channel information and manage video uploads. Access is authorized through Google OAuth and may be revoked at any time using the Disconnect YouTube control in Falling West Social Manager or through your Google Account security permissions.
Use of YouTube API Services is also subject to Google’s Privacy Policy and applicable YouTube API Services policies.
5. User Content and Uploads
You are responsible for ensuring that any content you authorize for upload through Falling West Social Manager is original, properly licensed, or otherwise authorized for use.
Content uploaded to YouTube must comply with YouTube’s Terms of Service, Community Guidelines, copyright requirements, and other applicable policies.
Falling West Social Manager does not grant any right to upload infringing, unlawful, deceptive, harmful, or unauthorized content.
6. Third-Party Services
Falling West may integrate with third-party services such as YouTube, Google, Meta, Pinterest, TikTok, WooCommerce, and other service providers. Your use of those services may also be governed by their own terms, privacy policies, and platform rules.
Falling West is not responsible for outages, policy changes, account restrictions, API limitations, or service interruptions caused by third-party platforms.
7. Privacy
Our handling of personal information, account authorization data, and YouTube API data is described in our Privacy Policy.
8. No Guarantee of Availability
We may modify, suspend, or discontinue features of the website or Falling West Social Manager at any time. We do not guarantee uninterrupted access to third-party APIs, hosting services, social-media platforms, or other external systems.
9. Limitation of Liability
To the extent permitted by applicable law, Falling West is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, Falling West Social Manager, or third-party services.
Nothing in these Terms limits rights or remedies that cannot legally be excluded under applicable consumer-protection law.

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date.
